A trademark is a proprietary word, phrase, symbol, letter, or design (or a combination such as a word and design) that identifies the source of a particular party’s goods (products) and distinguishes that party’s goods from the goods of others.  A service mark is functionally identical to a trademark, except that it is used for services rather than goods.  A trademark/service mark can be the name of a business or organization, a brand name for a product or service,  a collective mark to indicate membership in a particular group, or a certification mark to indicate that a product or service meets certain standards.  Examples of terms that may be eligible for trademark protection include brand names for products and services; business names; logos and symbols for businesses, products, and services; slogans and taglines; names of non-profit organizations; artist, band, and performer names; names of print and electronic publications; names of educational courses and services; bar and restaurant names; and food and beverage brand names, to name a few.  For more information about trademarks from the United States Patent and Trademark Office, please click here.
